Districts have been hit with a large and increasing number of complaints which require time consuming investigations involving sexual harassment allegations, complaints against employees such as hostile work environment, student on student bullying, and race-based discrimination complaints, among others. The common theme in a lot of these complaints is that they involve a tremendous amount of cross-over between personnel and student issues including how the investigation is conducted and once completed, what required (and crucial) elements need to be included in the findings and investigation report. As students and employees return to in-person instruction and work, the educational environment will continue to see the trend of this employee/student complaint nexus. We will provide attendees with guidance on applicable Board Policies, Administrative Regulations and laws for the types of complaints brought. We will also share our direct experience with handling the investigation, interviewing witnesses, reviewing evidence, generating the investigation report and making the findings and recommendations necessary.
